Terms & Conditions

1. Acceptance of Terms

By requesting services, signing an estimate, work authorization, emergency service authorization, change order, or otherwise allowing AMS Restoration Inc. (“AMS Restoration,” “Company,” “we,” “our,” or “us”) to perform work, the Customer (“Owner,” “Client,” or “You”) agrees to these Terms and Conditions.

2. Scope of Work

AMS Restoration shall perform only the services specifically identified in the approved estimate, work authorization, insurance-approved scope, or signed change order.

Any additional work requested by the Customer or required due to hidden conditions shall require written approval before work proceeds unless emergency measures are necessary to prevent additional damage.

3. Emergency Mitigation Services

Emergency mitigation services are intended to minimize additional property damage and may include:

  • Water extraction
  • Structural drying
  • Temporary repairs
  • Board-up
  • Roof tarping
  • Demolition of non-restorable materials
  • Mold prevention measures
  • Pack-out and content protection

Emergency services are billed regardless of whether an insurance carrier ultimately accepts or denies coverage.

4. Insurance Claims

AMS Restoration may assist Customers with documenting losses and communicating with insurance carriers.

However:

  • AMS Restoration is not an insurance company.
  • We cannot guarantee claim approval.
  • Coverage decisions remain solely between the insurance carrier and the policyholder.
  • Insurance estimates may differ from contractor estimates.
  • Any unpaid balance remains the responsibility of the Customer.

5. Customer Responsibilities

The Customer agrees to:

  • Provide safe access to the property.
  • Maintain active utilities unless otherwise directed.
  • Remove valuables, cash, firearms, medications, jewelry, collectibles, and personal documents.
  • Notify AMS Restoration of any hazardous materials or unsafe conditions.
  • Secure pets during work hours.

AMS Restoration is not responsible for loss or damage to unsecured valuables.

6. Hidden Conditions

Damage concealed within walls, ceilings, flooring, crawlspaces, attics, cabinetry, framing, or structural components cannot always be identified during the initial inspection.

If concealed damage is discovered, additional work and costs may be necessary.

7. Mold Disclaimer

Water damage may result in mold growth if not promptly addressed.

Unless specifically contracted, mold testing, mold clearance testing, industrial hygiene services, and environmental consulting are not included.

8. Change Orders

Any work outside the original scope shall require a written Change Order.

Pricing may increase due to:

  • Additional damage
  • Code requirements
  • Manufacturer requirements
  • Material availability
  • Customer requested upgrades
  • Engineering requirements
  • Structural repairs

9. Drying Expectations

Drying times vary depending upon:

  • Building materials
  • Moisture saturation
  • Humidity
  • Temperature
  • Ventilation
  • Weather conditions

AMS Restoration does not guarantee a specific drying timeline.

10. Reconstruction Scheduling

Reconstruction begins after:

  • Mitigation is complete
  • Moisture goals are achieved
  • Required approvals are received
  • Materials become available

Insurance restoration projects often experience scheduling delays outside the Company’s control.

11. Customer Upgrades

Any upgrades beyond insurance-approved repairs shall be separately billed.

The Customer is responsible for all upgrade costs before installation unless otherwise agreed.

12. Payment Terms

Payment is due upon:

  • Completion of work;
  • Insurance funding;
  • Progress billing milestones;
  • Contract terms.

Late balances may accrue interest at the maximum amount permitted by California law.

Customer agrees to pay all reasonable collection costs, attorney’s fees, and court costs incurred to collect unpaid balances.

13. Right to Suspend Work

AMS Restoration reserves the right to suspend work for:

  • Non-payment
  • Unsafe conditions
  • Denied access
  • Customer interference
  • Utility interruptions
  • Weather events
  • Material shortages

14. Limited Warranty

AMS Restoration warrants workmanship for one (1) year from substantial completion unless otherwise stated.

Manufacturer warranties remain the responsibility of the manufacturer.

This warranty excludes:

  • Normal wear
  • Abuse
  • Structural movement
  • Acts of God
  • Plumbing failures
  • Roof failures
  • Foundation movement
  • Moisture from unrelated sources
  • Customer modifications

15. Limitation of Liability

To the fullest extent permitted by law, AMS Restoration shall not be liable for:

  • Loss of use
  • Lost income
  • Business interruption
  • Consequential damages
  • Incidental damages
  • Emotional distress
  • Delays caused by third parties
  • Insurance claim decisions

16. Force Majeure

AMS Restoration shall not be liable for delays caused by events beyond its reasonable control including:

  • Weather
  • Fire
  • Flood
  • Earthquake
  • Labor shortages
  • Material shortages
  • Utility interruptions
  • Government actions
  • Pandemics
  • Civil disturbances

17. California Law

These Terms shall be governed by the laws of the State of California.

Venue for any dispute shall be the county where the work is performed unless otherwise required by law.
